I am reading for the DPhil in Law at Lady Margaret Hall, University of Oxford. My research focuses on the election of commercial remedies in private law.
Sometimes, claimants have available to them more than one possible remedy. This is true both where they can plead and prove multiple causes of action, as well as when they have pleaded and proved only one. In some cases, claimants can obtain both remedies (eg rescinding a contract and obtaining damages for fraudulent misrepresentation). In other cases, claimants can obtain only one remedy (eg it is not possible to obtain damages for a breach of a warranted pre-contractual representation as well as rescind the contract). The cases have not explained the principles behind when and why a claimant must elect between remedies. This DPhil project seeks systematically to explain those principles for the first time.
My research is supervised by Professor Robert Stevens. The funding generously provided by the OOC AHRC DTP is matched by Lady Margaret Hall, University of Oxford, via the Ann Kennedy Scholarship.
Prior to commencing the DPhil, I read BA Classical Tripos at Fitzwilliam College, University of Cambridge (2016-2020), BA Jurisprudence at Jesus College, University of Oxford (2020-2022), and the BCL at Trinity College, University of Oxford (2022-2023).
